This all depends on the level of the person's mental disability. The American Association on Intellectual and Developmental Disabilities (which changed its
name from the American Association on Mental Retardation in 2006) defines someone as mentally retarded if they fill the following criteria:
They have an IQ below 75. They are limited in two or more adaptive skill areas (defined as the daily skills needed to learn live and work in the community, including communication and social skills). Their condition is present from childhood which is classed as 18 or younger, to distinguish from conditions such as Alzheimer's disease or brain trauma through an accident.
The term Mentally Retarded is usually included within the broader developmental disability category and has become an offensive name in some countries.
The estimation is that seven million people with developmental disability live in the United States alone and the total population contains around 2-3% with these issues. Clearly, this definition will take in a large variety of individuals and some will certainly not have the capability of driving. Mentally Retarded individuals, however, do have the
same rights to drive as any other person as long as they can pass the Department of Motor Vehicles tests.
